By accessing or using this app, you agree that your access to and use of the app are subject to these terms and conditions and all applicable law. If you do not agree to these terms and conditions, please do not use this app.

These terms apply to the Lottery Places app on every platform on which it is offered, including Apple iOS and Android. In these terms, "Speednet" refers to Speednet Group LLC.

Disclaimer

The lottery retailer information and locations presented in this app are provided to the best of our ability. Because the app displays information sourced from dozens of government lotteries around the world, we are not liable or responsible for any use of the app or its services, and we make no representations or warranties, express or implied, that the retailer information and locations presented are complete, accurate, or free from errors or omissions.

Copyright

The entire content of this app, including but not limited to text, graphics, formatting, layout, and code, is copyrighted as a collective work under United States and other copyright laws, and is the property of Speednet. Permission is granted to use the app on your mobile device for the sole purpose of locating lottery retailers and viewing information about them for non-commercial, personal use only. Any other use, including but not limited to the reproduction, distribution, display, or transmission of the content of this app, is strictly prohibited unless authorized by Speednet.

Trademarks

LOTTERY PLACES is a registered trademark of Speednet, registered on the Principal Register of the United States Patent and Trademark Office (Reg. No. 4,890,625). The LOTTERY PLACES name and logo may not be used without explicit written authorization from Speednet.

Warranty Disclaimer

This app and the materials in it are provided "as is" and without warranties of any kind, whether express or implied. To the fullest extent permissible under applicable law, Speednet disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Speednet does not represent or warrant that the functions contained in the app will be uninterrupted or error-free, that defects will be corrected, or that the app or the servers that provide its content and data are free of viruses or other harmful components. Speednet makes no warranties or representations regarding the use of the materials in this app in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability, or otherwise. Some jurisdictions do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

Limitation of Liability

Speednet shall not be liable for any special, indirect, incidental, or consequential damages that result from the use of, or the inability to use, the app or its services, or the performance of those services.

Access and Use

This app, together with its related server-based components, is provided for your use after you download it from an official app store (such as the Apple App Store or Google Play). You may not reverse-engineer, decompile, or disassemble the app or its electronic communications. You may not access the app or its server-based data by any automated means, or through any browser, script, or other software not provided by Speednet, and you may not scrape, copy, or harvest the data the app provides. You may not allow another person, group, or company to use your device for the purpose of attempting any activity prohibited by this section. Speednet may pursue all available legal remedies against anyone who attempts to do so.

Feedback and Submissions

The app may allow you to send feedback to Speednet. You agree not to submit any content that is unlawful, abusive, defamatory, obscene, infringing, or otherwise objectionable. Any feedback you submit may be used by Speednet to operate and improve the app, without restriction or obligation to you.

Term; Termination

These terms and conditions apply to you upon your accessing the app and/or using any of the content or data it provides. These terms and conditions, or any part of them, may be terminated by Speednet without notice at any time, for any reason. The provisions relating to Copyright, Trademarks, Disclaimer, Warranty Disclaimer, Limitation of Liability, Indemnification, and Miscellaneous shall survive any termination.

Notice

Speednet may provide notice to you through a general notice within the app or by any other reasonable method available to Speednet.

Indemnification

You agree to indemnify, defend, and hold harmless Speednet, its officers, directors, employees, agents, licensors, and suppliers (collectively, the "Service Providers") from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your use of the app (including negligent or wrongful conduct) by you or any other person using your device.

Third-Party Links and Services

To provide increased value to our users, the app may link to or hand off to apps, websites, or services operated by third parties. For example, the app can open a third-party mapping or navigation app (such as Apple Maps, Google Maps, or Waze) to display driving directions to a lottery retailer. Speednet has no control over these third-party apps and services, all of which have separate privacy and data-collection practices independent of Speednet. They are provided only for your convenience, and you access them at your own risk. Speednet nonetheless seeks to protect the integrity of its app and welcomes feedback regarding both its own app and any third-party services it connects to (including if a link or hand-off does not work).

Miscellaneous

Your use of this app shall be governed in all respects by the laws of the State of New Jersey, U.S.A., without regard to its choice-of-law provisions, and not by the 1980 U.N. Convention on Contracts for the International Sale of Goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this app shall lie in the state or federal courts located in Somerset County, New Jersey. Any cause of action or claim you may have with respect to the app must be commenced within one (1) year after the claim or cause of action arises. Speednet's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Speednet may assign its rights and duties under these terms to any party at any time without notice to you.
